NCBA Supports House Vote of Disapproval of WOTUS, But Pushback Must Continue

NCBA Supports House Vote of Disapproval of WOTUS, But Pushback Must Continue Another attempt to stop the Waters of the U.S. rule has taken place in the House. The House voted and passed S.J. Res. 22, a resolution to disapprove the Waters of the United States rule. The Senate passed a similar measure in November by a vote of 53-44. While the vote doesn't have force of law, it does send a strong message from Congress to the White House and the Environmental Protection Agency (EPA) regarding WOTUS. National Cattlemen's Beef Association (NCBA) Vice President of Government Affairs Colin Woodall said this House vote is a priority issue for NCBA.


"It's very important that the House of Representatives follow the lead of the U.S. Senate by passing this resolution of disapproval," Woodall said. "By doing so, it sends a very clear signal to the President that Congress is not happy with the Waters of the United States rule and that they want to see it go away or be significantly changed. So, I think it's just another step in our continuing effort to try to ultimately kill the Waters of the United States rule."


Woodall said he is thankful the U.S. Sixth Circuit Court of Appeals in Cincinnati judges have issued a temporary nationwide stay preventing implementation of WOTUS in all 50 states. He said reminds cattle producers that the action is temporary.


"Producers really need to understand that this stay is temporary, so while it is providing us a little relief, it is not relief that we are going to be able to rely upon," Woodall said. "In order to make sure that we take this threat away and protect producers and make sure that EPA cannot come on your land, Congress has to act and they have to stop this rule. This motion or effort to try to do the resolution of disapproval is one step in the overall process, but there is still more Congress is going to have to do in order to ultimately win, because the last thing we want is for this to linger in the courts for four to five years and ultimately leave our entire fate to a decision that could go as high as the Supreme Court."


Woodall said it's important that cattle producers keep pushing on their lawmakers when it comes to issues related to EPA. The agency will move on to other issues and there are always regulations that threaten or impact cattle producers. He said that's why the cattle industry needs to stay on top of these issues to get Congressional action to push back. Without action, Woodall said the President will put out more rules and regulations. If the House and Senate both pass this resolution of disapproval of WOTUS, Woodall said President Obama will have to think about his next action, knowing he is getting a clear signal from Congress that the actions EPA have taken so far have been the wrong ones.
