Trump Water Rule Now Being Contested In Court, Forcing NCBA To Defend Government Rule, Says NCBA's Scott Yager

The Navigable Waters Protection Rule, the Trump administration's replacement for the Obama era WOTUS rule went into effect June 22 and the focus since has turned to the courtroom where so-called "blue" states are attempting to overturn the Trump rule.
Scott Yager, Chief Environmental Counsel of the National Cattlemen's Beef Association, recently talked with Radio Oklahoma Ag Network Farm Director Ron Hays about that courtroom battle.
The Trump administration repealed WOTUS in September of 2019 and all this has now gone to a courtroom battle, Yager said.
I think there are about 13 different court challenges in blue states trying to knock it down in court, Yager said. If you can kill it in court then you cast doubt on its legal validation, he said.
It clouds the whole issue and that is the strategy being used by environmental activists in the blue states, Yager said.
The NCBA, along with other like-minded trade groups, are strategically intervening in these court cases to shore up the defense of the rule.
We are standing with the government to defend it in courts which is something we typically don't do, Yager said.
Colorado is the only state where the Trump water rule is not in effect and instead is relying on an old rule from 1987 because a federal judge in Colorado issued a "stay" of the Trump rule.
That decision has been appealed so Colorado can also benefit from the Trump rule, Yager said.
The Attorney General in Colorado does not like the Trump rule, so he is challenging the rule, Yager said.
A coalition of blue states, which does not include Colorado has filed their appeal in northern California to get a favorable judge.
It's basically a reversal of the role of "judge shopping" for the NCBA when the Obama WOTUS rule was implemented.
