Oklahoma Cattlemen’s Association Supports Stay in Oklahoma v. Poultry Integrators Case

The Oklahoma Cattlemen’s Association (OCA) supports a stay of enforcement in the Oklahoma v. Poultry Integrators ruling while the case proceeds through the federal appeals process.


“This lawsuit, which has been litigated for more than 20 years, involves complex legal and scientific questions with broad implications for Oklahoma and perhaps national livestock production,” said Michael Kelsey, OCA Executive Vice President. “OCA believes a stay is appropriate to ensure that far-reaching decisions affecting livestock producers, landowners, supply chains and rural communities are not implemented before appellate review is complete.”


OCA’s support for a stay is consistent with existing membership-created policy on phosphorus management that recognizes phosphorus from any source, when properly managed, does not negatively impact surface water quality. As well, nutrient management decisions should be based on current research, sound science, and site-specific conditions, rather than arbitrary limits that fail to account for Oklahoma’s diverse soils, topography, and climatic conditions. Pre-defined phosphorus caps that do not reflect regional differences or field-level conditions undermine effective nutrient stewardship and place unnecessary burdens on agricultural producers who
already operate under comprehensive nutrient management plans.


“Granting a stay during the appeals process maintains stability and fairness while ensuring that the legal process is allowed to fully consider the scientific and regulatory issues involved. OCA urges the court to grant a stay,” said Kelsey.
